New Jersey's top prosecutor resigns following judicial deems ineligible her appointment.

The former personal attorney for Donald Trump has stepped down as the US Attorney for New Jersey. This follows a legal ruling that challenged her legal standing to occupy the role.

Acceptance of Resignation

The nation's top law enforcement official, the Attorney General, confirmed her stepping down on Monday. In a statement that the court's "flawed" ruling made it "untenable" for Habba to lead the department effectively.

"But do not mistake adherence to the ruling as defeat," she wrote. "This battle will now reach across America."

Court Ruling

The departure was triggered by a federal appellate panel determined that she had been acting without proper authority as the top prosecutor. This ruling is expected to impact scores of criminal cases in New Jersey.

The judicial panel said that a interim role that did not receive Senate approval ran afoul of the Federal Vacancies Reform Act.

Future Role and Reaction

It was also stated that Habba will remain at the Department of Justice as a senior adviser. Habba plans to pursue additional appeals of the disqualification, in the hope of achieving a reversal.

In a statement, she argued that the court "cannot be permitted to override the President's choice of lawyers tasked with executing the fundamental role of the presidency of enforcing the law."

Performance in Office

Bondi praised the prosecutor's work and said that while she was in charge, the state capital of Newark saw a one-fifth decrease in crime. It was also reported that the Camden recorded its first summer in 50 years with no murders.

Background and Previous Role

Habba, was initially recruited to Trump's personal legal team in recent years. She went on to acted for Trump in his business records case in 2024, when he was conviction on 34 counts of financial record manipulation.

Prior to assuming the federal prosecutor position, the former president had stated he was selecting her as his White House advisor if re-elected, calling the lawyer as a steadfast ally and a dedicated fighter for justice.
